NEBRASKA STUDENT DISCIPLINE ACT

The Lakeview Community Schools will adhere to the Nebraska Student Discipline Act, Nebr. LB 658 and Nebr. Law 79-263 through 79-295.   Copies of this act are available upon request from the school’s administrative office.

 

AUTHORITY

Students should fully understand that any employee in the building has the authority to correct misconduct at any time.   All students must comply with any and all reasonable directives from any school employee.

 

DISCIPLINE

In order for Lakeview High School to operate at its best, it is important that everyone help create an atmosphere which is conducive to learning.   Nonproductive and negative conduct or behavior by students will not be tolerated.   Our goal for education is that all students have an equal opportunity to a basic education.   No student has the right to deprive or interfere with any other student’s right to that education.

With the above in mind, Lakeview High School will take any necessary action in regard to inappropriate behavior.

After the teacher has tried to change the conduct of the student, and the student has not met the expectations of the teacher, the following measures will be used.

  1. assign detention
  2. contact parents
  3. referral of the student to the office

Detention:   If a teacher decides to use detention as a deferent to misconduct, the following applies:

  1. The student will report five minutes after the final period dismissal bell to detention hall.   Tardies to detention hall will have an additional hour assigned.
  2. The student will bring school work to do (no magazines).   It must be work to be done for school.
  3. Detention will be held after school on Monday through Friday.
  4. The student will not sleep or pretend to sleep.
  5. The person in charge of detention will give the names of the people in detention to the principal following the end of the detention period.

All detentions will be served at the end of the school day on the day given or at the end of the school day on the next school day following the date given.   Any student not serving their detention one of these two days will have the detention time doubled and shall serve the first hour of the doubled detention on the day issued.   Any student not serving this doubled detention may receive an in-school suspension, out-of-school suspension, or shall be subject to expulsion.   All detentions will be served prior to any after school activities or practices.   Students will have to make arrangements accordingly for rides or with their employers to serve detentions within the allocated time frame.

The complete Board policies and administrative rules and regulation for student discipline are posted in the school.   These policies, rules, and regulations are in accord with LB 1250.

The following student conduct shall constitute grounds for reprimand, detention, suspension or expulsion when such activity occurs on school grounds or during an educational function or event off school grounds.

  1. Use of violence, force, coercion, threat, intimidation, bullying or similar conduct against any student, school employee, or other person.
  2. Willfully causing or attempting to cause substantial damage to private or school property or stealing or attempting to steal private or school property.
  3. Causing or attempting to cause physical injury to a school employees or to any student, except in self-defense.
  4. Extortion of any student.
  5. Possessing, handling, or transmitting any object or material that is ordinarily or generally considered a weapon.
  6. Engaging in the unlawful possession, selling, dispensing, or use of a controlled substance, alcoholic liquor, tobacco, or items representative there of.
  7. Public indecency.
  8. Sexually assaulting or attempting to sexually assault any school employee or any student.
  9. Engaging in any other activity forbidden by the laws of the State of Nebraska which constitute a danger to other students or interferes with school purposes.
  10. Repeated violations of rules and standards established by the school.
  11. Engaging in any activity that is reflective of gang affiliation.
  12. Disrespect.

Depending upon the severity of the infraction, any step at any time could be used including expulsion.   A letter to parents will be used as well as phone calls to inform the parents of the student involved in a serious infraction.   At any time the district may require the student to seek counseling, psychological evaluation, or psychological instruction at the student’s expense.

Procedures for all types of exclusion are on file at the school.   Parents and students will be made aware of procedures if and when it becomes necessary.   Any action taken against a student will comply with existing state and school board policies and shall afford the student due process.

Note:   If a grade or grades are given on the day a student is suspended from school, the student will receive a zero for that grade.

 

IN-SCHOOL SUSPENSION

The following procedures shall be followed by any student who receives an in-school suspension:

  1. The student shall report to the office on the day of the suspension.
  2. The student shall bring home work and reading material for the day.
  3. No radios, games, cards, sleeping, etc, will be allowed.
  4. The student will eat lunch in seclusion.
  5. The student will not get up from the assigned suspension seat without permission.
  6. The student shall get assignments from each of their teachers prior to school on the day of their suspension.
